Terms of Service

These Terms of Service ("Terms") govern your access to and use of Surventrics ("we," "our," or "us") and our survey platform, website, and related services (collectively, the "Services").

1. Acceptance of Terms

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Services. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Services

Surventrics provides a self-optimizing survey platform that enables users to create, distribute, and analyze surveys. Our Services include:

  • Survey creation and customization tools
  • Survey distribution and response collection
  • Analytics and reporting features
  • Variant testing and optimization
  • API access (on applicable plans)

3. Account Registration

3.1 Account Creation

To use certain features of our Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or use of your account.

4. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable laws

5. Your Content

You retain ownership of all content you create, upload, or collect through the Services ("Your Content"), including surveys, questions, and response data.

5.2 License to Us

By using the Services, you grant us a limited license to use, store, and process Your Content solely to provide and improve the Services. This license does not give us ownership of Your Content.

5.3 Responsibility

You are solely responsible for Your Content and ensuring it complies with applicable laws and these Terms. We do not pre-screen content but may remove content that violates these Terms.

6. Payment Terms

6.1 Subscription Plans

Some features of the Services require a paid subscription. Fees are based on the plan you select and are payable in advance.

6.2 Billing

Subscriptions renew automatically unless cancelled. You authorize us to charge your payment method for recurring fees until cancellation.

6.3 Refunds

Fees are generally non-refundable, except as required by law or as explicitly stated in our refund policy.

7. Intellectual Property

The Services, including all software, design, text, graphics, and other content (excluding Your Content), are owned by Surventrics and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Services without our written permission.

8. Termination

8.1 By You

You may terminate your account at any time through your account settings or by contacting us.

8.2 By Us

We may suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason with reasonable notice, except in cases of serious violations where immediate action is required.

8.3 Effect of Termination

Upon termination, your right to use the Services will cease immediately. You may export Your Content before termination. We may delete Your Content after a reasonable retention period.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SURVENTRICS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Surventrics, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services or violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website. Your continued use of the Services after such changes constitutes acceptance of the new Terms.
